Installer Partner Agreement

This Installer Partner Agreement ("Agreement") is between Compare the Charger ("we", "us", "our") and the installer or installation business registering for a partner account ("Installer", "you"). By completing the installer registration process and ticking the acceptance checkbox, you agree to be bound by this Agreement.

1. Eligibility

To register as an installer partner you must:

• Hold all licences, registrations, and certifications required by law to perform electrical and EV charger installation work in your nominated service areas.
• Be a legal entity or individual legally entitled to conduct business in Australia.
• Have a valid Australian Business Number (ABN) or Australian Company Number (ACN).

2. Accuracy of Information — Your Responsibility

You are solely responsible for the accuracy, completeness, and currency of all information in your installer profile, including but not limited to:

• Company name, ABN/ACN, and contact details.
• Licences, certifications, and insurance details.
• Service area postcodes and localities.
• Business summary and specialties.
• Availability and response times.

You must update your profile promptly whenever any of these details change. Compare the Charger is not responsible for errors, omissions, or outdated information that you have failed to update. You indemnify Compare the Charger against any claims, losses, or damages arising from inaccurate or outdated information in your profile.

In particular, you must not allow your profile to show you as available in areas or for services you cannot lawfully provide. If your licence or certification lapses, you must immediately update your profile to reflect this.

3. Subscription Plans and Fees

3.1 What you pay for

Your subscription entitles you to access the features associated with your chosen plan tier. Plan features may include, but are not limited to:

• A verified installer profile visible to customers in your service area.
• Access to quote requests submitted by customers matched to your service area.
• Priority placement in installer search results (higher tiers).
• Analytics and lead tracking (higher tiers).

The specific features included at each tier are set out on our subscription page and may be updated from time to time with reasonable notice.

3.2 Billing and payment

Subscription fees are billed in Australian dollars on a recurring basis (monthly or annually, depending on your selection). Fees are charged in advance and are non-refundable except where required by the Australian Consumer Law.

All prices are GST-inclusive unless stated otherwise. A tax invoice will be issued for each payment.

3.3 Changes to fees

We may change subscription fees by providing at least 30 days' written notice. Continued use of the service after the effective date constitutes acceptance of the new fees.

3.4 Cancellation

You may cancel your subscription at any time from your account dashboard. Your profile will remain active until the end of the current billing period, after which your listing will be removed from the public directory. We do not provide refunds for unused portions of a billing period unless required by law.

4. Quote Requests and Customer Relationships

Quote requests are delivered to you as introductions only. Compare the Charger is not a party to any agreement between you and a customer. Any contract for installation services is between you and the customer directly. We make no warranty about the quality or suitability of any lead.

You must respond to quote requests in a professional and timely manner and must not contact customers for any purpose other than responding to their specific quote request without their consent.

5. Compliance with Laws

You must at all times comply with all applicable Australian laws, including electrical safety legislation in each state and territory in which you operate, consumer protection laws, and workplace health and safety laws.

6. Prohibited Conduct

You must not:

• Provide false or misleading information in your profile or in communications with customers.
• Perform work outside the scope of your licence or certification.
• Solicit referrals or reviews from customers in a manner that is false or misleading.
• Attempt to manipulate search rankings through artificial means.

7. Intellectual Property

You grant Compare the Charger a non-exclusive, royalty-free licence to display your profile information, logo, and images on the Site for the purpose of connecting you with potential customers. You retain ownership of your intellectual property.

8. Termination

Either party may terminate this Agreement with 30 days' written notice. We may terminate immediately if you breach this Agreement, provide false information, lose required licences or certifications, or engage in conduct that may harm Compare the Charger or its users.

9. Limitation of Liability

To the maximum extent permitted by law, Compare the Charger's liability to you under or in connection with this Agreement is limited to the fees paid by you in the three months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, or special loss, including any loss arising from a failed or disputed installation.

10. Australian Consumer Law

Nothing in this Agreement excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

11. Governing Law

This Agreement is governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
